What is the Workplace Safety & Loss Prevention Program?

This program, mandated by the 1996 Workers' Compensation Reform Bill, is designed to improve workplace safety, reduce injuries and lower the cost of workers' compensation insurance in New York State.

Any employer with an experience modification above 1.20 and payroll exceeding $800,000 is required to participate. Employers who must participate receive written notification from the New York Compensation Insurance Rating Board that a consultation and evaluation by a certified workplace safety and loss prevention consultant is necessary.

 The insurance carrier then checks to ensure that all recommendations have been implemented. If the employer has not complied, the carrier is mandated to apply a five percent premium surcharge for each year of non-compliance.
